These Terms and Conditions (“Agreement”, or “Terms”) are a legally binding agreement between Chance Software LLC. (“Blazed Cloud,” “we,” “us,” “our”) and

(i) Visitors: Visitors are any person that visit our website or App but do not have any Account on our Platform or have not subscribed to our Services; and

(ii) Subscribers: Subscribers are all Visitors who have a registered Account on our Platform and successfully completed Registration as per Section 4.

Subscribers and Visitors are collectively referred to as “Users”. All Users acknowledge and agree that their use of the Blazed Cloud platform (“Platform”) or accessing Blazed Cloud’s websites, Blazed Cloud’s application programming interface, or and Blazed Cloud’s mobile application (collectively the “Services”) will be governed by this Agreement, our Privacy Policy, and any related terms. If Users are uncertain as to the terms of this Agreement, they should not proceed further and contact us at [email protected]. User’s use of our Services shall constitute User’s acceptance of this Agreement and to all of the terms and conditions stated under this Agreement and our Privacy Policy referenced herein.

PLEASE NOTE THAT THESE TERMS CONTAIN A BINDING AND MANDATORY ARBITRATION PROVISION AND CLASS ACTION/JURY TRIAL WAIVER PROVISION.

Welcome to Blazed Cloud, a service provided by Chance Software LLC. These Terms of Service (“Terms”) govern your use of Blazed Cloud’s services, so please read them carefully.

1. Acceptance of Terms:

By accessing or using Blazed Cloud, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, you may not use our services.

2. User Accounts:

To use Blazed Cloud, you are be required to create a user account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Privacy:

4. Use of Services:

You agree to use Blazed Cloud in compliance with all applicable laws and regulations. You are solely responsible for the content you upload or share through our services.

5. Eligibility

To be eligible to access our Service, Visitors must warrant that they are 18 years of age or older. Visitors must also warrant that they have full power and authority to enter into this Agreement and doing so will not violate any other agreement to which they are a party

6. Security:

We take security seriously. However, you acknowledge that no system is entirely foolproof, and we cannot guarantee the absolute security of your data.

7. Termination:

We reserve the right to terminate or suspend your account at any time, with or without cause. You may terminate your account by requesting deletion through our applications, or emailing us directly with the email address assigned to your account at [email protected]

8. Changes to Terms:

We may update these Terms from time to time. Continued use of Blazed Cloud after changes constitutes acceptance of the revised Terms.

9. Disclaimer of Warranties:

Blazed Cloud is provided “as is” and “as available.” We make no warranties, expressed or implied, regarding the reliability, availability, or accuracy of our services.

10. Limitation of Liability:

To the extent permitted by law, Chance Software LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of Blazed Cloud.

11. Governing Law:

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles.
